Company Director Disqualifications 2024 - 2025
New data released by the Insolvency Service reveals that over 1,000 company directors have been disqualified in the last year – with a sharp focus on Covid loan abuse.
Published on 14 April 2025, the Insolvency Service Enforcement Outcomes 2024–25 report lays bare the growing crackdown on directors who have breached their duties or misused government-backed financial support schemes such as the Bounce Back Loan Scheme (BBLS).
This article explores what the findings mean, the legal implications for directors, and what you should do if you’re concerned about your own position.
Key Findings from the Report
-
1,036 directors were disqualified across England, Scotland, and Wales in the 2024–25 reporting year.
-
The average length of disqualification was 8.3 years.
-
A significant 736 of those disqualifications (71%) were directly linked to Covid loan abuse, primarily misuse of Bounce Back Loans.
-
The longest bans (averaging 9.4 years) were issued in relation to Covid loan misuse cases.
-
In addition to director bans, 131 bankruptcy and debt relief restrictions were imposed – with 87 of these also linked to Covid loan abuse.
Bounce Back Loan Abuse Still Under the Microscope
The Bounce Back Loan Scheme, introduced in 2020 to support small businesses during the pandemic, has become a focal point for enforcement.
Although it was intended to provide urgent financial relief, some directors used the funds for personal use, overstated turnover, or failed to repay the loan before dissolving the company – all of which breach the terms of the scheme.
Now, four years on, the Insolvency Service is continuing to investigate and take action against directors where misuse is suspected.
Dave Magrath, Director of Investigation and Enforcement Services at the Insolvency Service, said:
“Disqualifications for more than one thousand directors demonstrates the impact our investigative work is having. Whether it be Covid loan abuse or directors breaching disqualification restrictions, we are consistently tackling misconduct and bringing those responsible to account.”
What Can a Director Be Disqualified For?
A director may face disqualification under the Company Directors Disqualification Act 1986 for:
-
Failing to keep or preserve adequate accounting records
-
Not submitting accounts or returns to Companies House
-
Not paying taxes such as VAT or Corporation Tax
-
Misusing government support, including Bounce Back Loans
-
Trading while insolvent or failing to act in creditors’ best interests
Disqualifications can last up to 15 years, during which time individuals are legally prohibited from:
-
Being a director of any UK company
-
Promoting, forming, or managing a company (even informally)
-
Acting as a director of a foreign company with UK connections
Breaking the terms of a disqualification is a criminal offence that could lead to a fine or imprisonment of up to 2 years.
Bankruptcy and Debt Relief Restrictions Also on the Rise
In addition to disqualifications, the report highlights that 131 individuals were subject to extended bankruptcy restrictions – in cases where the court deemed their conduct dishonest or blameworthy.
87 of these cases related to Covid loan misuse, with restriction periods averaging 9.5 years.
This reinforces the message that both solvent and insolvent directors can face serious consequences where misconduct is identified.
